摘要
认为新的“物权”形式的出现是业主委员会制度产生的法理基础,社区自治制度的推行是业主委员会制度产生的政治基础,公共物品理论是业主委员会制度产生的经济学基础;业主委员会的法律地位定位不准确,业主委员会的成立难以启动;对业主委员会缺乏有效的监督机制和公民参与不足是目前业主委员会制度的现实困境。指出合理定位业主委员会的法律地位,强化政府在业主委员会组建中的作用,建立合理的组织构架,完善对业主委员会的监督机制,培养社区意识,引导居民参与社区管理,是完善业主委员会制度的制度选择。
The appearance of new "real right" is the legal law foundation of owner committee system, the implementation of community autonomous system is the political foundation of owner committee system, and the public goods theory is the economic foundation of owner committee system. It is the realistic predicament of owner committee system that the legal status of it is inaccurate, that the establishment of it is difficult, that the effective surveillance mechanism to it is weak and that the public participation to it is insufficient. This paper suggests that reasonable legal position should be given to the owner committee, the influence of government should be strengthened in it, reasonable institution should be set up, supervision mechanism to it should be improved, community passion should be cultivated and lead-ing residents to participate in best system choice.
