论变性人的法律地位及权利救济——以人权入宪为时代背景

变性人的出现对传统的道德和现有的法律产生了极大的冲击,变性人已经形成了一个不容忽视的社会群体,并一步步走进公众的视野。虽然这些人在数量上占绝对的少数,但我们不能因此忽略他们的存在,更不能忽视他们的合法权益,如何对待他们,如何规范他们的行为,是法律所应予以考虑的问题。我国是人权公约的缔约国,宪法明确规定国家有尊重并保障人权的职责和义务,我们必须要修改原有人权本源宪政理念,加强立法,在法律上对变性人提供权利保障。通过对特殊人群的保护,增强人们的人权意识。

The apperance of the transsexual has caused a great challenge to traditional morality and present legal sanctions. We can not disregard their existence even more their legal rights though the amount is small. China concluded treaty on International Covenant On Civil and Political Rights and International Covenant Economy, Society＆ Culture, moreover, Constitution of The peoples Republic Of China confirmed obligation which the state respects and protects human rights. We must amend our former concept about human rights, enhancing legislation to ensure rights protection of the transsexual. To strengthen the people＇s consciousness on human rights, we must provide particular group with rights and interests.
