摘要
新的《医疗广告管理办法》即将实施,但其中存在若干法律问题:设定医疗广告审查制度缺乏明确法律依据,部分行政处罚的设定超越法定权限,用语不科学,表述不严谨。这些问题的存在不仅影响该项立法的正当性、科学性,更直接影响其实质性效果。行政立法应进一步从制度和操作层面入手,提高立法质量。
Regulations on Medical Advertising which has been amended will carry out, but it has some problems. For exampie, the establishment of checking up on medical advertising is short of dear legal basis, some administrative penalty setting up exceeds legal extent of authority, and terms are less rigorous. Not ordy do these problems influence the legislation's justification, but also its implement. Administrative legislation should improve its quality from the respects of system and practice.
