劳动公益诉讼制度建立的思考

劳动公益诉讼作为公益诉讼的一种,是公益诉讼制度在劳动法领域的典型适用。由于我国当前存在着劳动公益诉讼立法的严重缺失,对于目前众多公司、企业日益严重既损害劳动者合法权益又损害社会公共利益的现象,弱势群体劳动者依法维权显得苍白无力。根据我国实际国情,建立劳动公益诉讼制度,来维护劳动者合法劳动权益和社会公共利益,促进社会的和谐发展。

The labor public interest action as a kind of public interest action is used typically in the system of public interest lawsuit on the field of labor law . Because of being seriously short of labor public interest action legislation, the weak community vorker are unable to protect their legal rights as to the phenomenon of the havoc to the worker＇s legitimate rights and interest and the harm to society public interest in mang company and enterprise. Therefore,based on the actual situation in our country, the labor public welfare lawsuit should be established in order to protect the laborer＂s legal right and interest as well as social public interest and promote the society＂s harmonious development.
