略论宋代法官行为责任制

On Judge behavior responsibility system of Song Dynasty

古代中国行政和司法不分,当然也就没有职业意义上的法官群体。但是,出于维护社会稳定、解决纠纷的需要,履行审判职能的群体还是存在的。有宋一代,司法制度相对而言比较完善,审判人员的职能分工也比较明确,并对审判人员的审判行为和责任以及其个人职业道德的修养都有具体的要求。宋代相对完善的法官责任制,应合了当时社会发展的需求。

There were no professional judges in Ancient Chinese because administration and administration of justice did not divide. However, it comes into being that judge colony safeguards the social stability and solves the dispute. The judicial system was relatively perfect in Song Dynasty, clearer in function of trying personnel, and a concrete demand so that it tries the behavior and personal professional ethics training. Studying the responsibility system of the judge in Song Dynasty sheds lights on the improvement of the modern judge＇s responsibility system.
