摘要
分析了我国土地征用制度的缺陷,指出目前我国土地产权安排仍存在主体不明确,征地补偿还延袭计划经济时期的补偿标准,政府行为集经营者和监督者于一身,职能不清的问题。认为,要使中国征地制度适应市场经济发展的要求,必须在制度上进行重新构建,促进土地这个重要生产资料的高效利用。
The objection of land expropriation system is analyzed. Points out that, the defect of land expropriation system of China is due to the ambiguous main body of land property, the compensation standard deriving from planned-economy period in the land expropriation, as well as the unclear duties of the governments as the operator and supervi^r in tandem. Considers that, to enable Chinese land expropriation system to match the need of market economy development, it is necessary to rebuild the system structurally in order to reach a high utilization of land.
