近年来,因离婚而引起的债务纠纷屡见不鲜。《婚姻法解释(二)》第24条在确立夫妻债务的承担方式、强调维护第三人利益的同时却忽视了夫妻当中非举债一方利益的保护。因此,有必要清晰界定共同债务与个人债务的范围,合理分配婚姻关系当事人和债权人的举证责任,以便实现双方的利益平衡。

Then the burden of proof should be distributed on a reasonable basis. Only by this can we balance the interests of the spouse and the creditor.
