善意取得制度是民法体系中的一项重要法律制度,是因应市场经济发展需要而产生的一项有关物权变动的特殊交易规则,其涉及所有权保护与交易安全的价值取舍问题,我国物权法草案对该制度作了相关规定。

In order to meet the requirements of economic development, the system of Bona Fide Acquisition is established that is an important part of the science of civil law. It is the special business regulation on changes of real right, and the core of the system of Bona Fide Acquisition is the balance between protection of ownership and safety of transaction. Furthermore, the related rules have been drawn up in Chinese Draft of the Real Right Law.
