摘要
不动产物权变动中的公证制度是大陆法系关于不动产交易的重要制度。法国、德国、瑞士民法将公证作为不动产转让合同的形式要件,并建立公证与登记的配合机制以保障不动产的交易安全。我国不动产物权变动与法国、瑞士一样实行登记要件主义,但我国相关法律未规定不动产交易的公证制度,物权法草案也将公证制度付之阙如。借鉴法、德、瑞士的立法例,在我国即将颁布的物权法中规定不动产物权变动的公证制度有着重要意义。
Notary system plays a positive role in changes of real right for the security of immovable transaction. French, German and Swiss Civil Codes regard notary as an essential element of contractual form in transfer of real right. Notary system coordinates with register system in order to ensure the changes of real estate. Our Civil Law is based on the continental legal family, so it is necessary to refer to the perfect system of French law, German law and Swiss law. Our systems of changes of real fight adopt creation mode of publication. However, there' s no notary system in our present statutes and regulations related. It is important to establish notary system in our property law.
