论我国保障措施程序制度之不足及完善

On the Defects and Perfection of the Procedure Rules on the Safeguard Measures

保障措施是一种由于进口商品数量增加,对进口国生产同类产品或直接竞争产品的国内产业造成严重损害或严重损害威胁,进口国采取的进口限制措施。本文在对我国保障措施程序制度的重要性介绍之后,阐述了我国《保障措施条例》现有程序性规定的不足之处。在本文最后,对完善我国保障措施程序制度作了一些建议:注重行业协会的参与、建立预警机制、增强保障措施程序制度的系统性和完整性。

Safeguard measures which restrain import are often taken by importing country when me enlargement about the quantity of import commodities causes serious damage or intimidation on the industry of the importing country that produces the product of the same kind or direct competition products. This article elaborates the defect of present procedure rules on Regulations on Safeguard Measures after introducing the importance of procedure rules. In the end of this article, some advice is given on improving the procedure rules of the safeguard measures： laying stress on the participation of guild, establishing the early warning mechanism, enhancing the systematicness and completeness of the procedure rules on the safeguard measures.
