论我国域外送达机制的完善

The Discussion of the Perfection of Service Abroad

随着国际民商事交往日益紧密,涉外纠纷也日益增多。在涉外民商事案件的解决过程中,国际司法协助的作用不可忽视,域外送达机制是司法协助中重要的方面。我国的域外送达机制在制度上存在很多缺陷,实践操作中送达周期长,效率低下,阻碍了涉外案件的圆满解决,本文借鉴了欧美国家域外送达机制方面的先进制度,提出我国在这方面应予以完善的地方,以期抛砖引玉。

With the increasing of international civil and commercial matters, there are more international conflicts. Judicial assistance is important in settling of international civil cases. Service abroad is indispensable in judicial assistance. There are a lot of problems in Chinese practice of service abroad, such as a low success rate. This article introduces the advanced service systems in occident countries and gives some advice to the perfection of our country.
