摘要
法律原则往往是构成一部法律的基石,由此演绎出的法律规则既有明确的规则,也有模糊的规则,其基本的表现形式是“另有规定的除外”。几乎所有的现行法律中均含有这样的规则,论述如何正确认识这些模糊规则,并还之以法律本有的精神。
Legal principles are always the basis of a law and they result in both clear legal rules and fuzzy ones, whose form is the sentence we often mention： ＂except the ones with other rules＂. Through research it is discovered that almost all the existing laws contain such rules. How to realize these fuzzy rules and turn them into the true meaning is discussed.
