论弱势群体的司法救济

On Judicial Relief of Vulnerable Group

目前弱势群体的许多基本权利受到侵害而无法行使诉权,对弱势群体的司法救助条件和程序比较混乱,诉讼释明引导明显不足。在对弱势群体进行司法救济的可行性进行论证后,提出应当确立宪法司法保护机制、扩大救助范围、明确救助条件和程序、建立诉讼保险制度,并就如何正确行使释明权,加强对弱势群体的诉讼引导提出了自己的观点,以期引起全社会对如何完善弱势群体司法救济问题的关注。

At present there is difficult to exercise the rights of litigation for the vulnerable group when their fundamental rights are infringed, a comparably disorder of the condition and procedure of judicial relief for them, an obvious lack of litigation explanation. After discussing the feasibility of judicial relief for the vulnerable group, the author suggested we should sot up a constitutional system of judicial protection, enlarge the range of relief, make clear about the condition and procedure of judicial assistance, establish the insurance system of lawsuit, and offered some suggestions how to exercise the explanation right and strengthen the litigation leading for the vulnerable group, so as to cause the public attention to the judicial relief for the vulnerable group.
