摘要
破产财产分配或案件执行过程中,歇业或破产的企业、公司经理人的工资债权能否也堪如雇工工资一样优先受偿?因其法无明文规定,理论上又鲜有论述,构成司法难题。解决这一难题,可以雇工工资优先权的价值取向及经理人法律定位所折射的内涵为依托,以经理人工资债权与雇工工资债权的法律属性之迥异为视角。
In the course of property distribution and case execution of bankrupt industries and companies, should their managers' salary be payed in advance like the workers? Because there is no concrete regulation and theoretical explanation, it becomes a legislative proplem. To solve this problem , we should distinguish the workers ' salary and the managers' salary debt based on the idea of workers' salary priority.
