第三人侵害债权制度的构成要件

对第三人侵害债权的情形,以传统民法理论构建的法律制度对债权人保护不足。世界上许多国家为了弥补传统法律的不足,在司法实践中逐渐形成了第三人侵害债权制度。而我国法律上没有对该制度的规定。本文对侵害债权侵权行为的构成要件问题进行了探讨。

It is not enough for legal system made up of traditional civil law to protect creditor when the third party aggrieves creditor＇ s rights. The system of the third party aggrieves creditor＇ s rights was gradually set up in the judicature practice to make up the limitation of traditional law in many countries, but there is no clauses in China to rule this system. The paper is to discuss the important documents of aggrieving creditor＇ s rights.
