The Defining of "Energy Services" within the WTO/RTAs Framework

虽然GATS的重要文件W/120未将“能源服务”作为独立分类,但是许多国际组织和RTAs对“能源服务”的范围进行了探索。在DDA能源服务谈判建议中,当WTO具体承诺委员会开始讨论是否需要将能源服务单独设立为具体部门时,许多成员方如美国、加拿大、欧盟、挪威、日本、智利等纷纷提出各自的谈判建议书,他们在“能源服务”的界定上存在较大分歧。研究这些谈判建议书对“能源服务”的界定及其分歧,对于中国确定能源服务的谈判立场和策略,提出符合中国国情的能源服务谈判建议具有重要意义。

The important document MTN. GNS/W/120 does not include a separate comprehensive entry for energy services, but many international organizations and RTAs have carried out researches for the scope of ＂energy services＂. When the CSC of WTO has focused on whether there is a need to create a specific sector for energy services, many WTO members such as the United States, Canada, EU, Norway, Japan, Chile, etc. have made their suggestions to the WTO among which there exist many differences about the definition of ＂energy services＂. It is of great implications for China to sketch out the negotiation standpoint and strategy and make the relevant proposal for energy service negotiations in conformity with China＇ s reality on the basis of the study on the definitions and differences in other members＇ proposals.
