The paper gives a detailed analysis and examination to the related provisions as to the carrier＇s rights of suit against the holders of the bills of lading under the contract of carriage of goods by sea in the Carriage of Goods by Sea Act 1992 under English law and the Draft Instrument on Transport Law proposed by UNCITRAL; Then it points out the lacuna and summarizes the main issues experi- enced in judicial practice in China in this respect; Based upon such a comparative study, the paper recommends legislative advice in respect of requirements for the imposition of the contractual liabilities upon the holders of the bills of lading on the reformation of the Chinese Maritime Code.
