摘要
实现刑法现代化的关键首先在于实现刑法理念的现代化,我国目前应该树立权利本位刑法观、坚守刑事法治、保持刑法谦抑。结合目前刑法运行的实践,这三个理念应该取得符合现代刑法运行实践的合理内涵。
The key of criminal law modernization is to actualize the modernization of criminal ideology at first. Now we should establish standard of right, carry out rule by criminal law, keep modesty of criminal law. Based on the questions during criminal law operation, the paper analyses the modern intention of three ideologies.
