论不能犯与能犯未遂的区分标准

On the Standard of Dividing Impossibility and Possible Criminal Attempt

不能犯作为犯罪未遂的一种类型,具有行为的危险性。但由于行为人主观的认识错误致使行为不可能达到既遂,因此既遂不能是不能犯的一个重要特征,也是其与能犯未遂的重要区分标准之一。既遂不能的原因可以分为手段错误和对象错误两种情况。

Impossiblility is one kind of attempted crime, so it h as the behavior of risk, but because the behavior person＇s subjective understanding wrongly causes the behavior impossible to achieve the crime, therefore it is an important characteristic of impossibility; also it is one of the discrimination standards. But the reason why the act is not being able to complete the crime may be divided into two kinds of situation： one is the method mistake and the other is the object mistake.
