Crimes of Rape-within-the-marriage——An Analysis from the Social Gender Perspective

社会性别分析是一种以社会性别理论为指导的分析问题的方法。文章在对妇女性自由权利及其限制进行法理分析的基础上,运用社会性别分析方法对婚内强奸非罪的理论进行了质疑和批判,指出“婚内强奸非罪论”及其理论基础“女方承诺论”反映了男性权力对女性的压迫。首先,它们从内容上实现了对女方性自由权利的彻底剥夺;其次,它们将男性的意志强加于女性;最后,它们歪曲了婚姻的目的。“婚内强奸非罪论”不但使为人之妻的那些妇女的性自由的权利得不到法律的保护,而且,对这种权利造成了更大的威胁和侵害。

Social gender analysis is under the guidance of the theory of social genders. Based on the legitimated analysis of fight and the limitation of freedom on females, the present article raises questions on and criticizes the crimes of rape-within-marriage, pointing out that the non-rape-within-marnage and its theory of ＂female- promise＂ shows the oppression from the males since it deprives the freedom from females in the first place. Then, it is an indication of the force of the will of males on females. Finally, it misrepresents the true purpose of marriage.
