摘要
我国民事诉讼立法虽然对人数不确定代表人诉讼作了较为详细的规定,但至今尚无实践。学者对这一制度的完善建议多集中于法律文本层面,而本文试图从当事人、法院和律师三个维度,对人数不确定代表人诉讼实施的相关社会条件加以分析,认为以中国目前的国情,这一制度没有适用的空间,应通过多元化途径来解决群体性纠纷。
Although indefinite population representative＇s lawsuit system is regulated relatively in detail in civil procedure legislation, there is no precedent in Chinese judicial practice. The improvement suggestions made by some scholars focus on the legal text. The social conditions related to the application of indefinite population representative＇s lawsuit system are analyzed in terms of party, court and lawyer. Thereby, it is argued that indefinite population representative＇s lawsuit system has no room for application in China now, and group disputes should be settled in a multiplex way.
