The Relationship Between Chinese Traditional Legal Culture and Modernization of Legality

当前中国正面临着一场前所未有的法制现代化革命,而中国传统法律文化是中国这片土壤培育出来的文化“植物”,是中国法律观念的历史沉淀。因此,在法制现代化过程中,必须客观地看待中国传统法律文化,对其有用的优秀成分加以继承利用,对于不适合社会法制现代化的部分坚决地予以批判,甚至抛弃。

A revolutionary modernization of legality, unparalleled in history, is being contemporarily launched in China, whereas Chinese traditional legal culture is, like a plant grown on Chinese land, the accretion of legal concepts in China. Therefore ,the Chinese traditional legal culture must be viewed objectively in the process of the modernization of legality. All that is beneficial should be inherited and adapted, and all that goes against the social legality modernization be criticized, even abandoned.
