随着我国环境问题的日益加剧,以及人们环境意识和法律意识的不断增强,有关环境问题的法律纠纷也越来越多。但由于我国环境方面的立法存在不健全之处,从而导致许多环境纠纷长期得不到合理解决,致使污染受害者的合法环境权益得不到有效维护,进而使矛盾激化,在一定程度上影响了社会的稳定与经济的发展。探讨如何树立环境权观念以及确立环境侵权责任,有着十分重要的现实意义。

Some problems in the environmental legislation makes the disputes unsettled for a long time, the legal environmental rights not be protected. And these promote the conflicts and have a great influence on the social stability and economic development. Therefore, it is necessary, in reality to study how to form the idea of environmental rights and set up the environmental tort liability.
