摘要
业主大会是全体业主的一个集合体,也可称为业主团体,代表和维护物业管理区域内全体业主在物业管理活动中的合法权益。业主委员会是业主大会的执行机构,代表业主大会或全体业主的意志。世界各国家和地区对业主委员会的法律界定不尽相同。我国关于业主委员会法律地位规定的模糊,尤其是当事人地位规定的缺失,导致实践中诸多问题。赋予业主委员会当事人资格有利于维护业主合法权益和纠纷的解决。
Proprietor assembly is an aggregation of all proprietors, it can be named pr, oprietor group, which represents and defends the lawful rights and interests of all proprietors during the estate management behaviors in the estate management areas. The proprietor committee is the actuating mechanism that represents thoughts of the proprietor assembly or the all propri- etors. There are different means on law of proprietor committee in different countries and ar- eas. In China, the lawful position of proprietor committee is not clear, especially the position of interested party, thus many problems emerge in practice. It is beneficial to defend the proprietors' lawful rights, interests and solve the dispute when the proprietors committee is given the qualification of the interested party.
