论网络侵权案件中司法管辖权的确认

网络空间的全球化和虚拟化使网络侵权案件的司法管辖界限变得模糊,也使得传统民事司法管辖的基础受到动摇和冲击。通过对网络侵权管辖现状的评析以及几种具有代表性的新学说的考察,发现在现有条件之下,僵化地适用传统规则和一般性地起用新的管辖根据都是不可取的,变通适用侵权行为地原则以及根据网络空间的特点确定一个指导性的原则,即最密切联系原则,并以侵权行为地、被告住所地、网址等常见的联系因素时该原则进行限制,再根据案件的实际情况确定管辖权的归属,是解决网络侵权案件管辖问题的有效途径。

The traditional jurisdiction was attacked by the globality and dummy space of network that result in the faintness of jurisdiction bounds. As to the jurisdiction of network tortuous cases, we must both develop and correct the traditional jurisdiction theory, and use for reference of new theory, and then the equitable and efficient ju- risdiction will be established. On the basis of researching into traditional jurisdiction and evaluating new theory, we discover that it is necessary to combine the traditional jurisdiction with the new characteristics of network and use it neatly, and also establish ＂most contact＂ in principle as a fundamental rule restricting with tortious place, house place of privy, address of network, as acting accordingly with traditional and new theory are both inviable.
