论国家赔偿费用的来源

On the Source of the State Compensation Expenses

国家赔偿费用来源制度是整个国家赔偿制度的重要组成部分,而我国的国家赔偿费用来源是单一的、不充足的,有地方化、部门化的倾向,这是受害人不能获赔的重要原因之一。因此,在与域外的国家赔偿费用来源制度进行比较研究后,文章提出要扩充国家赔偿费用的来源,建立国家赔偿费用基金制度。

The system of source of state compensation expenses is the important part of that of state compensation. The expenses, however, are simple, incomplete and the trend of localization, which is the major causes that the casualties can not be made up for. Therefore, the article raises increasing the sources of the state compensation and establishing the fund system of the state compensation after comparing the system of the state compensation overseas.
