我国众多的出口企业正面临着发达国家专利壁垒的挑战,开办专利侵权责任保险是其对策之一。该险种承保被保险人因侵害专利权而遭受的损害赔偿和相关费用。瑞士再保险公司的示范合同对该险种作出了相关规范,我国应借鉴和参考国际惯例,为潜在的专利侵权人(即被保险人)提供保险保障。
