摘要
陪审团制度正式演变成参审制是从德国开始的,通过对这个过程的更广阔视角的分析,可以发现除了包含德国当时诉讼制度特点和陪审团自身缺陷的原因外,陪审团制度在德国的消亡还具有复杂的政治、经济、社会背景和环境因素。
It was from Germany that the jury system officially develops into the mixed court one. From a broader perspective on this evolution, the author analyzes the reasons why the jury system vanished in Germany, which includes the characteristics of the current litigation system in Germany, the defects of jury system as well as the complicated political, economic and social background.
