论变更型逮捕的条件

“变更型逮捕”是指被取保候审、监视居住的犯罪嫌疑人、被告人因严重违反法定义务而对其变更强制措施予以的逮捕。“变更型逮捕”性质上仍然是一种逮捕措施,它的目的在于保全刑事审判及执行的进行,因此它必须符合一般逮捕的条件。犯罪嫌疑人违反取保候审或者监视居住的规定,只表明其具备了一般逮捕中的必要性条件,对其是否采用逮捕,还必须审查其是否具备另外两个条件,即证据条件和刑罚条件。只有犯罪嫌疑人同时具备一般逮捕的三个条件,才能适用“变更型逮捕”。
