摘要
当前我国劳动领域出现了一些问题,如何评价与应对?文章深入剖析了“劳资冲突说”和“劳动者分层保护说”。“劳资冲突说”认为资方劳方之间存在阶级冲突,作为整体的有产者和劳动者在经济上的权利和地位处在此消彼长、尖锐对立的状态。“劳动者分层保护说”则认为,不宜将劳动者简单地视为一个阶层,而应分为四个阶层,各个阶层的利益有同有异,应根据各自特点采用不同的保护策略。当前劳动领域出现的一些问题主要是由于底层劳动者保护不够导致的,并不能因此而认为劳资双方存在尖锐的阶级冲突。这两种学说在劳动法的调整对象、调整方法、调整原则上均存在着分歧,并影响着当前的立法。
How should we evaluate and manipulate the problems that are occurring in the labor field of our country? We have developed two doctrines, one concerned with "Conflicts Between Laborers and Capitalists", and the other with "Protection of Classified Laborers". These two doctrines have been affecting the current legislation. Whether the labor - capital relationship should be in static harmony or dynamic harmony is a problem of the intelligence of our lawmakers.
