From the concepts of the labor and human capital, we deliberate the relationship between labor and human capital contribution after clarifying the related concepts, pointing out that the two are identical substantively. And we review the history of legislation on human capital contribution at home and abroad, admit that the viewpoints of pros and cons are profound and remarkable about whether the human capital contribution should be permitted, while there is still room to discuss. Then we focus on the solution of how to construct the concrete mechanism of human capital contribution with help of analyzing the feasibility and obstacle for the subject. At the end of the paper, we demonstrate that it＇ s better to postpone the enactment for the human capital in China.
