论立法解释的概念及其特征

立法解释是由法定的主体在立法解释的权限内,遵守法定的程序,运用科学的解释方法对法的含义及意义进行解释和说明的活动。它包含三个特征:立法解释的法定性;立法解释的合程序性;立法解释的广泛性。目前,我国立法解释还存在着立法机关有权不用和越权使用,地方性法规的立法解释几乎为空白等问题。为此应强化立法解释工作,并坚持规范和合法原则。

Law explanation is an activity in which the meaning of the law is explained through a legal process, within the legislation fight by the legal body and with a scientific method. It has four characteristics as follows： characteristic of being legitimate ; eharaetefistie of agreeing to the legal procedure ; eharaetefistie of legislation and characteristic of universality. Now, there are still some problems of our country＇s law expaination, as don＇t use the fight and use the fight exceed the power. So we should strengthen the law explaination, insist on stardard and prineiple.
