摘要
授权理论和公务法人说不足以合理界定我国公立高等学校的法律地位。第三部门作为现代公民社会的主要结构性因素,能够弥补传统政府机制和市场机制的不足,实现教育产品配置的最优化。从公立高等学校与学生之间形成的法律关系,以及教育产品的准公共产品性质角度看,我国公立高等学校应当作为第三部门存在。
It's not appropriate to define the legal status of China's public colleges and universities by using the Authorized Theory or the Theory of the Official Legal Person. As the main structural factors of the modern society,the Third Sector is able to cover the inadequacy of the traditional government mechanism and the traditional market mechanism,and to realize the optimization of the educational product configuration. Based on the relationship between the public universities and students and the pre-public nature of the educational products,the universities in China should be considered as the Third Sector.
