关于建立法律权威的探析——从哈特到韦伯

Analysis of Establishing the Authoritativeness of Law

新分析实证法学派的代表人物哈特及社会法学派的代表人物韦伯均认为法学研究中应秉持价值中立的观点,同时认为人们的法律感对于建立法律权威具有重要的意义。通过对他们观点的梳理以期对我国法律权威的建立有所借鉴。

Both Hart, the representative of new legal science of positivism and Max Weber, the representative of the sociological school of law hold the point that in the study of the law we must insist on. Meanwhile, recognition of law will be of help to the establish authority of the law. By this article, the authors hope it will be help to the establish authority of the law in China.
