摘要
在死刑复核权回归的背景下,探索检察机关介入死刑复核程序涉及其双重角色的正当求证问题。基于检察监督权与公诉权之上下权能辨析,并合理构建检察机关内部的权力分野机制,检察机关在死刑复核程序中的双重角色并不存在逻辑上的悖论,相反它符合我国现行的司法权力分配与制度运行逻辑。
A research of the procuratorate＇ s participation associated with its legality proving in the background of the return of the capital - punishment - reexamination power. To analyze the power＇ s rank of supervision and partieipation along with constructing rationale inner - power distribution, procuratorate ＇ s dual character don＇ t have logical paradox in the procedure of capital - punishment - reexamination and it is in accordance with the logic of our judicial power distribution and the system running.
