Building a Community Corrections Penalty System Fitting Our Country's Situation

在一个重刑的国度却有着非常轻缓的非监禁刑制度是值得思考的。我国社区矫正的试点已有多年,但目前尚未建立起适合我国国情的社区矫正惩罚机制,不能形成监禁刑与非监禁刑、非监禁刑与行政处罚之间的较好衔接。通过与美英国家的比较,对惩罚机制的建立进行了初步的构想。

It is worth to thinking that there is very soft non - incarceration system in a hard penalty country. After several years of community corrections pilot in our country, community corrections penalty system fitting our situation has not been built up. This paper tries to explain the necessity of building the community corrections penalty system with comparison of America and England, and try to construct a potential penalty system.
