合立遗嘱的认定及其完善

The Affirmation and Perfection to Co-testament

现今世界各国及地区的民法对合立遗嘱有承认与否认两种截然不同的立法例,我国学界也存在肯定与否定两种针锋相对的学说。本人持肯定说,认为现如今合立遗嘱确有存在之必要,但应当严格限定。

Co - testament is such a testament which is two testators or more who agree with each other and agree to set a same testament. Nowadays, there are two contrary ideas which are accepted and reject in the civil law in the countries and districts all over the world. Also there are two reverse theories in our country. I incline to accept it, because it is significant and necessary to have such a testament, but it should be restricted strictly.
