摘要
商法的本质是指商法区别于其它法律的内在的质的规定性。商法属于特别私法,商法是市民社会发展的法律条件,商法是商品经济存在与发展的技术性条件。
The nature of commercial law is the inherent characteristics which distinguish commercial law from other laws. Commercial law is a special private law. It is both the legal condition with which the civil society develops and the technological condition for the existence and development of commodity economy.
