商业秘密不是物权法上的“物”,而是一种与专利不同的知识产品;商业秘密权不是一种与专利权一样独立开来的知识产权,而是属于公平竞争权。我国应由竞争法对商业秘密进行保护,并且这种保护是充分的。

Trade secret is not an object in the property right law, but is kind of intellective information. Trade secret right is an fair competition right, but not an unattached intellective property like patent right. Trade secret should be protected by competition law in our country, and this protection is sufficient.
