摘要
简要介绍了包括EST、SNP在内的DNA片段的技术背景,回顾了此类研究工具的专利保护给生物医药研究带来的冲击,在此基础上进一步讨论了授予研究工具专利权对此后的基础研究所产生的影响,认为:若对此类研究工具授予专利将会在很大程度上阻碍生物医药技术的进步,并提出相关的解决对策。
In this article, the technological background of DNA gragment, including EST and SNP, is described;the impacts of the patent protection for such kind of research tools on the biopharmacological research are reviewed; and the effects of granting patent for research tools on the basic research are analysed. Accordingly, a conclusion is drawn that,to a great extent, granting patent for research tools may hinder the development of biopharmacological techniques and specific solutions should be taken to solve this problem.
