摘要
“超越承担过失”是犯罪过失中的一类特殊形态,在注意能力方面有别于一般的过失,在当代社会背景下对其展开研究显得尤为必要。在中国大陆过失犯理论中,对此问题进行研究也是可行和必要的。
Negligence that is short of the attention ability is a special kind of criminal negligence and different from the general negligence in the attention ability aspect. It is necessary to launches the research for this question under the contemporary society background. It is also feasible and essential to research this question in the theory of Negligence in China's Mainland.
