中国残疾人社会保障法制建设的现状、问题与发展

The Present Situation,Issues and Development of The Social Security the Legal System Construction for the Disabled People in Chinese

我国残疾人的社会保障立法包括了五个方面,即:就业保障、基本生活保障、医疗与康复保障、教育保障和服务保障。受整个社会保障立法滞后的影响,残疾人社会保障法律制度亟待完善。在残疾人的社会保障法律体系的构建中,应当从立法角度促进残疾人社会保障事业,建立切合残疾人需求的社会保障制度,确保残疾人就业权的实现。

The social security legislation of Chinese disabled people comprises five aspects： the employment security, the basic life security, the security of medical treatment and rehabilitation, the education security and the service security. With the influence of the whole legislation＇s backward development, the social security legal system remains to be improved urgently. In order to build the social security legislation of Chinese disabled people, we should promote social security services of the disabled people in the legislative perspective. We should also establish the social security system that suits the need of the disabled people and ensure the realization of the employment rights of the disabled people.
