论民事诉讼失权制度的立法完善

On the Legislation Perfection of Civil Procedure Loss Right System

我国民事诉讼失权制度设计由于缺乏整体性考虑而呈现出“头痛医头,脚痛治脚”的局面。民事诉讼失权制度的立法完善需要:(1)设立证据失权制度;(2)设立答辩失权制度;(3)设立法院、检察院再审启动失权制度;(4)充实简易程序中民事诉讼失权制度;(5)建立民事诉讼失权的制度保障。

The design of civil procedure loss right system in China takes on the situation of ＂taking stopgap measures＂ because of lack of consideration as a whole. At present, the revisions of Law of Civil Procedure have become the hot spot in theoretical field, which provides the chance for considering civil procedure loss right system in China as a whole. The paper puts forward good ideas in perfecting civil procedure loss right system based on the investigation of the current situation of civil procedure loss right in China.
