试论当代国际社会的法治基础

On the Basis of Rule of Law in Current International Society

探讨国际社会法治的目标和现实路径是全球化时代难以回避的重大课题。文章从国际社会的内涵及其与法治的内在关联角度,探讨了当代国际社会正在发生的重大变革。作者提出,国际社会实行法治是一个不可逆转的历史过程,其现实基础来自于国际社会的内在变化,并认为国家原子化、从无政府文化向公民文化的转变以及从地缘政治向新型政制模式转化的三种变革趋势构成了当代国际社会建设法治的重要社会基础。

To study the goals and realistic approaches of international rule of law is one of the unavoidable and vital research projects in the age of globalization.This paper explores the significant changes that are taking place in contemporary international society from the perspective of inherent relationship between the essence of international society and the rule of law.The author argues that the implementation of the rule of law in international society is an irreversible historical trend,and its realistic basis comes from the inner changes of international society.
