论我国婚内侵权赔偿制度的建立

Building the Compensation Systems of Infringing Upon the Right During the Marriage Period in China

婚内侵权现象的广泛存在,不仅严重地侵犯了婚姻当事人的合法权益,而且也与我国的法治精神相悖离。本文通过对婚内侵权行为的界定,在分析建立婚内侵权赔偿制度必要性的基础上,提出了建立我国婚内侵权赔偿制度的基本构想。

The phenomena of infringing upon the right during the marriage period not only impinges seriously upon the lawful rights and interests of marriage party, but also deviates from the spirit of the rule of law in China. This article defines the behavior of infringing upon the right during the marriage period, analyzes the necessity to establish this kind of system and proves the legislation suggestion in our country.
