中国现行的行政解释体制研究

Study About The System of Chinese Active Administrative Interpretation

我国的行政解释体制是法律解释体制的一部分,既具有法律解释体制的一般特点,又表现出独特的个性。目前,我国行政解释在体制上矛盾重重,在理论研究上裹足不前,致使行政解释的命运岌岌可危。完善和改造行政解释已势在必行,未来行政解释的发展应该分两步走:一、近期目标是完善现行行政解释体制;二、远期目标是运用先进理论重构行政解释,改造行政解释。

In China, as a part of legal interpretation system, the system of administrative mterpretauon takes on distinctive personality as well as general character. Now, our administrative interpretation system is full of contradictions, and theory research hesitates to move forward, so that administrative interpretation is immersed in crisis. Under the situation, it is imperative to perfect and transform administrative interpretation. Future administrative interpretation should develop along two measures： firstly, the goal in the near future is to perfect active administrative interpretation; Secondly, long- dated goal is to useadvanced theory to rebuild and transform administrative interpretation.
