摘要
从人性角度而言,个人崇尚刑法保障机能、国家注重刑法保护机能,两个主体所预期的刑法机能大相径庭,因此有必要寻求二者视角的交汇点,这便是刑法的规范机能。一国刑法机能的具体定位受制于具体的社会情势。立足于我国现实,目前更应注重刑法的保障机能,从而达到自由与秩序的实质性平衡。
From the perspective of humanity,individuals value garantierende function, but the state emphasizes the protection function. The expectations to the function of criminal law are entirely different so it is necessary to seek a meeting point for both sides. Then we get normierende function. However, the location of function of criminal law in a country subjects to specific social situations. At present, based on the reality of our country, we should pay more attention to the garantierende function of criminal law, and thus we can achieve a substantive balance between liberty and social order.
