生育保险法制建设初探

Exploratory Research on Improving Legal System of Childbearing Insurance

利用有关统计资料,考察我国生育保险制度的实施现状可见:现行生育保险制度存在着覆盖面窄、待遇水平低、保险金未实现社会统筹、保险立法滞后等问题,生育保险法制建设亟待加强。为此建议:制定适合国情、全国统一的生育保险法律规范,进一步扩大保险适用范围,坚持保险基金的社会统筹并提高统筹层次,动态调整保险待遇水平,使之与社会生产力发展水平相适应。

By studying the present situation of Chinag maternity insurance with the related statistical data, the author takes it as an urgency to improve the legal system of maternity insurance with these problems ： narrow coverage, low level of indemnity, unfulfilment of the social pool of the fund and laggard legislation. The paper hence suggests to formulate a unified national insurance regulation in keeping with China＇s situation, to further expand the applicable scope, to persist social plan of insurance fund and to enhance the plan level and to adjust timely the insurance level in order to adapt it with the social development.
