基于经济学的国有公司及其高管犯罪边界判断

Border Judgment between Crime of State-owned Companies and Senior Managers' Crime in State-owned Enterprises in View of Economics

根据现行刑法规定区分公司犯罪和公司高管人员犯罪不是一件非常困难的事情,但是,仔细研究公司高管犯罪与公司犯罪决策的逻辑联系,可以发现公司犯罪中包含着高管个人利益动机,管理者(层)的利益趋动使寓有公司高管犯罪的公司犯罪成为可能。如何分析其内部联系,甄别两者性质,是文章研究的主要目的。

It is not difficult to distinguish the crime of company and senior management depend on the existing provisions of penalty.It could be found that company crime comprised the individual interest motivation and this interest motivation make it enable of senior manages＇ crime if analyze the logic relationship between Senior Manages＇ crime and the company crime decision-making.How to analyze their internal relationship and how to discriminate their nature is the primary objective of this paper.
