On the Effective Supervision of Multinational Banks in China:Analysis with the People's Republic of China on Administration of Foreign-funded Banks

本文以新近出台的《外资银行管理条例》及其实施细则为基础,分析了我国跨国银行监管法制①的现状,重点对跨国银行准入及经营的法律监管制度进行研究,并借鉴国外及国际跨国银行监管的有益规则和先进做法,为完善我国跨国银行监管法制提出若干意见。

The thesis is based on The Regulations of the People＇s Republic of China on Administration of Foreigu-funded Banks and The Rules for Implementing the Regulations of the People＇s Republic of China on Administration of Foreign-funded Banks which took effect recently, analyzing the status quo of the supervisory system of multinational banks in China. The author puts emphasis on the entry restriction and operation restriction for multinational banks. After following the lead of other countries＇ successful legislation and advanced implemention, the author presents her recommendations on strengthening and perfecting the supervisory system of multinational banks in China.
